UN DENIM GIFT CARD TERMS AND CONDITIONS

The following terms and conditions ("Terms") govern the purchase, use, and redemption of gift cards ("Gift Cards") issued by UnDenim.com (referred to as "Un Denim," "we," "us," or "our"). By purchasing, accepting, or redeeming a Gift Card, you agree to be bound by these Terms, in addition to Un Denim's general Terms of Use and Privacy Policy, which are incorporated herein by reference.

A. General Provisions and Legal Framework

1. Issuing Authority: UnDenim.com Gift Cards are issued by Shopify. Please note that there is no value per se stored on these Gift Vouchers and these can only be utilized for redemption into Gift Cards issued by Un Denim. Accordingly, these Gift Vouchers do not constitute 'pre-paid payment instruments' in terms of the Policy Guidelines on Issuance and Operation of Pre-paid Payment Instruments in India issued by the Reserve Bank of India, from time to time. By purchasing or using a Gift Card Voucher, you are agreeing to and accepting these terms and conditions.

2. Acceptance of Terms: The purchase, acceptance, or use of a Gift Card constitutes acceptance of these Terms. Un Denim reserves the right to modify these Terms at any time without prior notice. Any such modifications will be effective immediately upon posting on the Un Denim website.

3. Governing Law and Jurisdiction: These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore.

B. Purchase, Activation, and Delivery

Purchase Methods: Gift Cards can be purchased on www.undenim.com using valid credit cards, debit cards, net banking, or UPI. Un Denim reserves the right to restrict certain payment methods for Gift Card purchases at its sole discretion, including but not limited to existing international credit/debit cards, corporate credit cards, EMI options, Cash on Delivery.

Denominations: Gift Cards are available in various pre-defined denominations as displayed on the Un Denim website. 

Personalization: Purchasers may have the option to personalize digital Gift Cards with a message for the recipient.

Delivery: Digital Gift Cards will be delivered electronically to the recipient's email address provided by the purchaser at the time of purchase, typically within 30 minutes of successful payment.

Accuracy of Information: The purchaser is solely responsible for providing accurate recipient details (email address, mobile number). Un Denim shall not be liable for any Gift Card delivered to an incorrect or non-existent address due to purchaser error.

Activation: Digital Gift Cards are typically active upon delivery on e-mail.

C. Redemption, Usage, and Balance Management

Redemption Platform: UnDenim.com Gift Cards are redeemable exclusively for eligible products and services on www.undenim.com

Redemption Process: During checkout, users must select "Gift Card" as the payment option and enter the unique Gift Card code. The applicable purchase amount will be deducted from the Gift Card balance.

Full Balance Usage Policy: Gift Cards must be used in their entirety in a single transaction. The full available balance on a Gift Card will be applied to the purchase, and no balance can be carried forward for future use. This means:

• If the purchase amount is less than the Gift Card balance, the remaining balance will be forfeited

• If the purchase amount exceeds the Gift Card balance, the full Gift Card balance will be applied, and the remaining amount must be paid using other accepted payment methods

Multiple Gift Cards: Multiple Gift Cards can be combined in a single purchase.

Exceeding Gift Card Value: If a purchase exceeds the Gift Card balance, the full Gift Card amount will be applied first, and the remaining balance must be paid using other accepted payment methods (e.g., credit card, debit card, net banking, UPI).

Non-Reloadable and Non-Cashable: Gift Cards cannot be reloaded with additional funds, nor can they be redeemed for cash or credit.

Restrictions:

• Gift Cards cannot be used to purchase other Un Denim Gift Cards

• Certain products, categories, or services may be excluded from Gift Card redemption, and such exclusions will be clearly communicated on the product page or during checkout

Taxes and Duties: All applicable taxes, duties, levies, or other statutory dues and charges payable in connection with products purchased using Gift Cards shall be borne solely by the customer.

D. Validity, Expiration, and Revalidation

Validity Period: Each Gift Card shall have a validity period of one (1) year from the date of its activation or issuance, unless otherwise explicitly stated on the Gift Card itself.

Expiration of Unused Funds: Any unused balance on a Gift Card will expire automatically upon the expiry of the validity period.

Revalidation: Upon expiration, the Gift Card and any unused balance will become invalid. However, a customer may request revalidation of an expired Gift Card by contacting Un Denim customer service within 90 days of expiration. Revalidation requests will be reviewed on a case-by-case basis and may be subject to the following conditions:

• The revalidated Gift Card may have a shortened validity period (minimum 1 month)

• Revalidation is limited to one time per Gift Card

• Un Denim reserves the right to deny revalidation requests at its sole discretion

E. Refunds, Cancellations, and Returns

Gift Card Purchase Refunds: Gift Card purchases are final and non-refundable. Once a Gift Card has been purchased, it cannot be cancelled, returned, or refunded.

Order Cancellation/Return with Gift Card Payment:

• Full Order Cancellation/Return: If an entire order placed using a Gift Card is cancelled or returned, the corresponding amount will be refunded as follows:

• If the original Gift Card is still valid (not expired), the amount will be credited back to the same Gift Card

• If the original Gift Card has expired, the team will take it on a case basis to extend the validity of the card by limited period.

• Partial Order Cancellation/Return: If part of an order placed using a Gift Card is cancelled or returned:

• The refund amount will be issued to the original Gift Card and will be valid for the remaining period.

Product Returns: Returns of products purchased with a Gift Card will be processed in accordance with Un Denim's standard Return Policy.

No Cash Refunds: Gift Cards cannot be redeemed for cash or credit, nor can they be exchanged for cash refunds for returned items. All refunds for purchases made with Gift Cards will be issued only as Gift Card credit.

F. Additional Terms

System Availability: Un Denim shall not be liable for any inability to use Gift Cards due to system maintenance, technical issues, or circumstances beyond its reasonable control.

Fraud Prevention: Un Denim reserves the right to void any Gift Card obtained through fraudulent means, system manipulation, or in violation of these terms.

Modification of Terms: Un Denim reserves the right to modify these terms and conditions at any time. Changes will apply to Gift Cards purchased after the modification date.

Governing Law: These terms and conditions shall be governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore.
